Federal Legality of Stoned Teddy Products
Stoned Teddy products are federally legal for customer shipping under the 2018 Farm Bill, USDA Final Rule, and DEA Interim Final Rule (IFR). Defined as industrial hemp, our products contain less than 0.3% delta-9 THC on a dry-weight basis, complying with the Agricultural Act of 2014 and the 2018 Farm Bill. The 2018 Farm Bill defines hemp as cannabis (Cannabis Sativa L.) and its derivatives, including seeds, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, with no more than 0.3% delta-9 THC (7 U.S.C. §1639o(1)).
DEA Interim Final Rule (IFR)
On August 21, 2020, the Drug Enforcement Administration (DEA) published its Interim Final Rule (IFR), clarifying that hemp and hemp products with no more than 0.3% delta-9 THC on a dry-weight basis are not controlled substances. The definition of marijuana includes all parts of the Cannabis Sativa L. plant and its derivatives, which are Schedule I controlled substances unless they meet the hemp definition by containing less than 0.3% delta-9 THC. This ruling confirms that Stoned Teddy products are not controlled substances, as they adhere to the 0.3% delta-9 THC limit.
Lawful Transportation and Shipping of Hemp Products
The 2018 Farm Bill legalized industrial hemp at the federal level and prohibits states or Indian Tribes from restricting the interstate transportation or shipment of hemp and hemp products produced in compliance with Subtitle G of the Agricultural Marketing Act of 1946 (as amended by section 10113). This ensures that Stoned Teddy and our customers can lawfully transport and ship hemp products across state lines, provided they contain no more than 0.3% delta-9 THC on a dry-weight basis (7 U.S.C. §1639o(1)).

Stoned Teddy products are not available for shipment to the following states and territories: Alaska, Arkansas, California, Colorado, Hawaii, Idaho, Kansas, Louisiana, Michigan, Montana, New Mexico, Oklahoma, Oregon, Puerto Rico, Rhode Island, Utah, Vermont, Washington.
